Terms of Use & Conditions
This agreement describes the terms and conditions by which Consignment King offers you (hereby referred to as “the User”) access to its services. By using the services on Consignment King’s website (hereby referred to as the “Site”), you are agreeing to the following terms.
Changes to Terms & Conditions: Be informed that Consignment King. reserves the right to modify the Agreement at any time in Consignment King’s sole discretion by posting the modified terms on the Site. All modified terms will be immediately effective upon their posting on the Site. Your continued use of the Site after any posting of modifications and amendments to the Agreement constitutes your acceptance of such Agreement changes. If you do not accept any modifications and amendments to the Agreement, do not continue to access the Site and use its services and features.
1. USE OF THE SITE
Consignment King is an online venue for Sellers to post items for sale, and Buyers to buy these items. Consignment King facilitates the selling and buying of items, but is not involved in the actual transactions between Sellers and Buyers. As an entity, Consignment King will do its best to police its sellers but assumes no liability of monitoring the authenticity, quality, safety and legality of the items.. Consignment King cannot ensure that the Seller or Buyer will satisfactorily complete a transaction.
2. BUYER’S CONTRACT
Caveat Emptor — The buyer is responsible for performing any and all due-diligence before purchasing any items. It is the buyer’s sole responsibility to make any condition inquiries to the seller prior to purchasing. Once the item is purchased, the buyer is legally obligated to buy the item without any further inquiries nor contestations. Since items are being sold from properties that are often being fully liquidated, buyers are not allowed to return items to the properties in which they were purchased. The only event in which a refund may occur is if the item was incorrectly described and the buyer requests refund BEFORE picking up and signing the receipt.
All Sales are Final — Offers placed on the Consignment King website are a binding contract between the seller and the buyer. The buyer is responsible for paying all amounts due to Consignment King including sale price, buyer’s premium and all applicable taxes (rules for applicable taxes vary by state). Do not buy if you are unable to pay and take possession of the items in the specified time periods for each item. Do not buy if you have not performed your due diligence. All sales are final. No returns, credits or exchanges. An offer or purchase placed by any buyer shall be conclusive proof that the buyer read and acquainted himself/herself with the seller’s terms and conditions of sale and agree to be bound by such terms and conditions prior to completing any purchase with respective Seller.
3. ITEM DESCRIPTIONS
All items are sold as-is, where-is. Consignment King representatives are expected to do their best to list any damage, repairs, but any lack of further description does not imply that the item is in perfect or new condition. Most of the items listed on the Site are used. You should expect signs of wear consistent with age. Preview inspections may be offered upon request prior to purchase, but are not required. If you have any doubts or questions about any items, be sure to reach out directly to the Seller BEFORE purchasing. All sales are final. No returns, credits or exchanges.
4. PICK-UP & SHIPPING
PICK-UP:
Upon purchase, buyers must select a pickup time at the designated pickup location. Once the time is approved, buyers must pick up their items at the designated pickup location within the selected time frame. If you have any doubts about your ability to pick up your item during the selected time, DO NOT PURCHASE. If you are unable to pick up an item during the selected time frame, the item will be forfeited without refund unless another time is coordinated with the Seller 24 hours prior to your originally selected pickup time.
SHIPPING:
Consignment King is strictly a venue to facilitate successful transactions between Site Users. The Site currently does not offer any shipping or delivery service unless otherwise stated in the item’s description.
5. SALES TAX
All sales are subject to appropriate sales tax laws in the states where the sale is being held. Tax exempt Buyers must provide the appropriate state sales tax exemption certificate prior to purchase.
6. CREDIT CARD PAYMENTS
By providing your credit card information to Consignment King, you authorize Consignment King to charge your credit card for the purchase amount of any item. Failure to keep valid credit card information on file will result in your use of the site being terminated. To initiate your ability to buy on Consignment King, an initial $1.00 pre-authorization transaction will appear on your statement. This pending transaction will not settle and will drop off after 5 -7 business days.
You certify that you are an authorized user of this credit card and that you will not dispute the purchase payments with your credit card company provided the transactions correspond to the terms indicated in this authorization outline. Consignment King does not store your credit card information for security purposes which is held by reputable third party processors.
It is the sole responsibility of the user to ensure that their credit card on file is current and accurate. If your card is declined for any reason, you are responsible for contacting the Seller of the item directly to make payment directly and then update your card on Consignment King for future purchases.
7. FORFEITURE OF ITEMS
Any items not paid or not picked up during the specified pick up time will be forfeited by the Buyer without refund UNLESS a new pickup time has been scheduled 24 hours prior to the originally scheduled pickup time. Consignment King representatives, at their sole discretion, may re-offer the items or donate them to a charity of the Seller’s choosing. Consignment King reserves the right to report your account to collections for the combined total of the original invoice amount and any moving or disposal charges. Your membership with Consignment King will be revoked unless past due invoices and any additional charges are paid in full.
8. PROHIBITED USE
You agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adept, edit or create derivative works from content (including imagery) or materials on the Site. Use of the content and materials on this Site is prohibited.
9. LIMITATION OF LIABILITY, RELEASE & INDEMNITY
You will not hold Consignment King responsible for the actions or inactions of site Users, contents of their listings, items they list, nor their destruction of alleged fake and counterfeit items. Consignment King is simply a venue that connects buyers and sellers., if Consignment King is found to be liable for any damages or disputes, Consignment King’s liability to you or to any third party is limited to a maximum of the total fee, if any, paid to Consignment King only by you for the specific transaction(s) involved with the Buyer and the Seller. Consignment King is NOT responsible for any other costs related to shipping, restocking, legal or indirect fees involved in and/or resulting from the specific transaction(s).
10. TERMINATION
Consignment King may terminate, change, suspend, add-to or discontinue any aspect of the Marketplace or its service offerings at any time, in its sole discretion, and without any liability to any user. Consignment King has the sole right to terminate or suspend any user that does not follow the terms of use on its platform.
